1. Who We Are
Spiderwebbed is a web design service operated by Evelyn, based in San Jose, CA. These terms govern any website design, redesign, or related service ("Services") purchased through spiderwebbed.dev. You can reach us at hello@spiderwebbed.dev.
2. Project Scope & Pricing
Pricing and included features for each project are agreed upon before work begins, based on the package selected (Founding Client Site, Founding Client Menu Site, Founding Client Redesign, or a custom quote) and any add-ons purchased. Founding Client rates are limited-time offers available while spots remain; standard rates apply once those spots are filled.
Work beyond the agreed scope — additional pages, features, or major revisions beyond what was included — may incur additional charges, which will always be discussed and agreed to before any extra work begins.
3. Payment
Projects require a 50% deposit to reserve a project spot and begin work, with the remaining 50% due when the site is ready to launch. Deposits are refundable before design work begins; once a direction is approved and building has started, deposits are non-refundable. Monthly add-ons (Care Plan, Performance Report) are billed monthly and can be cancelled at any time with notice before the next billing date.
4. Monthly Care Plan & Recurring Services
The Monthly Care Plan and Monthly Performance Report are optional, opt-in subscriptions, billed separately from your one-time project fee on a monthly cycle starting from your enrollment date. They are never automatically bundled with a project purchase.
Cancel anytime: Email hello@spiderwebbed.dev to cancel — no phone call or account portal required. Cancellation stops billing at your next billing cycle; you keep full access through the period you've already paid for. We do not provide partial refunds for the current billing period.
If you cancel the Monthly Care Plan, your site stays live and online — cancellation only stops active updates, monitoring, and priority support going forward. It does not take your site down.
Pricing for recurring services will not change without at least 30 days' written notice.
5. Timeline
Estimated delivery timelines are provided at the start of a project and depend on how quickly the client provides needed materials (logo, photos, copy, feedback). Delays in client feedback may extend the delivery date. Rush delivery is available as a paid add-on where feasible.
6. Revisions
Each package includes a set number of revision rounds, as described on the pricing page at the time of purchase. Additional revision rounds beyond what's included can be added for a fee, agreed to before the work begins.
7. Ownership
Once a project is paid in full, the client owns the final website — the code, the domain (if purchased/transferred to their name), and any hosting account set up in their name. Clients on a Monthly Care Plan may choose to have Spiderwebbed retain hosting/domain administration for convenience, but ownership of the underlying work remains the client's. Spiderwebbed retains the right to showcase completed work in its portfolio unless otherwise agreed in writing.
8. Client Responsibilities
Clients are responsible for providing accurate business information (name, address, phone, hours, and other content) and for reviewing the site before launch. Spiderwebbed is not responsible for inaccuracies in content the client supplied and approved.
9. Limitation of Liability
Spiderwebbed builds and delivers websites to the agreed specification but does not guarantee specific business outcomes (traffic, leads, sales, or search rankings). Spiderwebbed is not liable for indirect or consequential damages arising from use of the delivered website, including third-party service outages (hosting, domain registrar, analytics, or similar providers) outside our direct control.
10. Acceptable Use
Our contact form and website are provided for genuine business inquiries. You may not use them to send spam, harass, threaten, or abuse Spiderwebbed or its owner, or to attempt to disrupt the site (including automated bot submissions).
To protect against this, we log the IP address and timestamp of contact form submissions for security purposes (see our Privacy Policy). We reserve the right to block any sender, email address, or IP address from submitting the contact form, without notice, if we determine in good faith that it is being used for spam, harassment, or abuse. This data is never sold or shared with third parties, and may be provided to law enforcement if a matter rises to the level of a genuine safety concern.
11. Project Cancellation
Either party may cancel a project before work begins with a full deposit refund. Once design or development work has started, the deposit is retained to cover work completed, and any additional work performed up to the cancellation point will be invoiced at the agreed rate.
12. Changes to These Terms
We may update these terms from time to time. Changes will be posted on this page with an updated date and do not retroactively apply to already-signed project agreements.
